The definition of marriage as it currently stands in Australia in s 5 of the Marriage Act is “…the union of a man and a woman to the exclusion of all others, voluntarily entered into for life.” A similar definition can also be found in the Family Law Act. Additionally, the ACT has enacted the Civil Partnerships Act 2008 (ACT) which applies to same-sex and opposite-sex couples.
