There are a number of issues that businesses should consider if enacting an e-commerce offering, and although not exhaustive, the following matters provide a basic introduction of some of the matters to be taken into account.

Fair business practices: the essential element in the conducting of fair business practices, is that a business should not act in an unconscionable manner, such as engaging in conduct that is misleading or deceptive, or likely to mislead or deceive. Additionally, businesses should not harass or coerce customers, and ensure that goods are of merchantable quality and fit for its stated purpose.

Contract terms are clear, accurate and easily available for customers: e-commerce contracts are no different from traditional contracts, therefore, all of the basic elements such as offer, acceptance, consideration and capacity are still applicable. Additionally, the contract must be easy for the customer to decipher, and find on the site.
