Q: What is a speeding penalty notice?

In New South Wales if your vehicle is detected speeding by a fixed speed camera, a mobile speed camera or a Police Officer you will receive a penalty notice which will give details of the traffic offence and the penalty.

Under the legislation the registered owner of a vehicle is considered to be guilty of the speeding offence, so if someone else was driving your car when it was photographed then you will need to supply a Statutory Declaration giving the name and address of the person who was in charge of your vehicle at the time of the offence.

A failure to nominate the driver of the offending vehicle or the false nomination of a person in charge of the vehicle will attract further penalties.
