Common Law Assault

Common law assault is heard in the County Court as it is a strictly indictable offence.

There is no defined maximum penalty for common law assault as it is not legislated and is more an issue off whether the penalty is excessive or not. 

The Prosecution must show that you unlawfully assaulted or beat another person. It will only be laid in circumstances where there is a an extreme example of assault
